This document regulates the legal conditions of sale by which MinandoVoy is governed.

2. THE USER

Hereinafter, any reference to "user" shall refer to any natural or legal person with the capacity to contract, who contracts or purchases any of the services and supplies offered by MinandoVoy.

The term "users" shall mean consumers over 18 years of age (of legal age) and legal persons who accept these legal terms and conditions of sale.

Within the users, there are two different ways to make the purchase process.

A registered user is a user who has created a customer account on the MinandoVoy website.

On the other hand, you can make the purchase as an unregistered user, so that you provide your e-mail address and data at the time of purchase.

The purchase process is divided into a series of steps, which are as follows: Step 1: Validation of the basket

There are two ways to make the purchase. Either, you add the product to the shopping cart, then access the cart and validate the basket by clicking on the

button to buy, showing in the basket all the selected products, the quantity of each product and the price of each product and the total price. Or you can select the buy button directly on the product.

Step 2: Provide billing and shipping details

Sistema de Reservas

1. Objeto
   Estos términos y condiciones regulan el procedimiento de reserva de productos (“Asic”) a través de nuestra página web. Al formalizar una reserva, el cliente acepta expresamente las siguientes cláusulas.
2. Identificación del Vendedor
   MINANDOVOY MINING CO. SL, con domicilio en www.minandovoy.com, CIF B24961401, correo electrónico [email protected] y teléfono +34 680751489, es la entidad responsable de la venta y entrega de los productos.
3. Proceso de Reserva y Pago
   • 3.1. Precio de Reserva. El cliente abonará, en el momento de la solicitud, el importe que figura como “precio de reserva” junto al producto seleccionado.
   • 3.2. Pago Final. El resto del precio total deberá abonarse en su integridad antes de proceder al envío. Hasta la recepción del pago final, el producto no será expedido ni entregado.
4. Determinación del Precio Total
   El precio total del Asic se compone del importe de reserva más el importe pendiente en el momento de pago final. Ambos importes serán comunicados con claridad al cliente, tanto en el momento de la reserva como en la confirmación por correo electrónico.

4. PRICES AND PAYMENTS

All MinandoVoy products show the product price excluding VAT until they are added to the shopping cart. This way of displaying prices is mainly intended for sales to companies and international sales, where VAT is not applied. VAT will only appear in the cart when the customer is located in Spain.

The following is included in the price excluding VAT:

-The installation and configuration of the product: this will only be carried out upon specific request by the user to MinandoVoy and after approval of the cost proposal sent by MinandoVoy.

Support and follow-up for 6 months in the event of any incident.

-All products are subject to warranty (the terms are specified in the "WARRANTIES" section).

The shopping cart will also break down the costs associated with shipping, which vary depending on the location of the destination.

The prices of the products are shown in Euro.

MinandoVoy reserves the right to change prices at any time without prior notice. However, the prices in force at the time of placing the corresponding order shall apply.

To proceed with the payment, the customer must follow the steps indicated in the purchase process, and use one of the payment methods allowed in MinandoVoy.

The charge will be made from the moment the order is placed.

MinandoVoy will not store data relating to credit/debit cards or other forms of payment (PayPal). This data will only be retained for the duration of the purchase process.

5. SHIPPING

MinandoVoy ships worldwide, including island and remote regions.

In order to calculate the cost of shipping, the cost will depend on the weight and price of the productThe following rates shall apply:

• 0 kg - 10 kg: 100 €
• More than 10 kg: 200 €

The estimated delivery time will be 15 to 20 working days from the time the machine is shipped. This means that the delivery time does not necessarily start on the day the order is placed, but rather on the day the machine is delivered. from the moment the product is shipped.

In case of return of the package due to incorrect or incomplete address, the user will be responsible for the cost of shipping the purchased product.

It is important to note that the shipping time and cost may vary depending on the price of the product and the destination. In addition, MinandoVoy is not responsible for production times or delays on the part of the manufacturer.and of the possible delays caused by customs.

Likewise, MinandoVoy is not responsible for lost or stolen packages once delivery has been confirmed by the courier.

6.  GARANTÍAS

All products on the MinandoVoy website come with a warranty period. With the exception of Asics products, which are exempt, all other products are guaranteed for 2 years.

For Asics products, the applicable deadlines shall be as follows:

Asics miners sold as "reconditioned" will have a 6 month warranty period.

Asics miners sold as new will have a 1 year warranty period.

In accordance with the General Law for the Defence of Consumers and Users, if the products do not conform to the description, type of goods, quantity and quality and possess the functionality, compatibility, interoperability and other characteristics established in the sales contract, the user will have the right to the repair or adaptation of the goods purchased.

The user must indicate the reason why the product needs to be repaired. Likewise, in accordance with the applicable legislation, the user has the right to have the product repaired in accordance with the rules of article 118 and following of the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (Revised Text of the General Law for the Defence of Consumers and Users).

7.  PROPIEDAD INTELECTUAL

With the sale of the products of MinandoVoythe company Minandovoy Mining Co S.L does not transfer any intellectual property rights in its products and services. All ownership of the intellectual property rights and other protected rights in respect of the products and services remain the exclusive property of Miandovoy Mining Co S.L.

9.  NORMAS DE USO Y LIMITACIÓN DE RESPONSABILIDAD

MinandoVoy cannot be held responsible for technical failures or interruptions of the web service. Nor can it guarantee the absence of viruses or other harmful components on the Website or on the server from which it is provided.

10.  LEGISLACIÓN Y JURISDICCIÓN APLICABLE

In order to simplify the settlement of civil claims and to reduce costs, we do not exclude the possibility of submitting to an Arbitration in Equity of the Court of Arbitration of the Chambers of Commerce and Industry.

In this respect, and in accordance with the applicable regulations, MINANDOVOY MINING CO. SL informs of the existence of a European online dispute resolution platform that facilitates the out-of-court resolution of such disputes for contracts also concluded online between consumers and internet service providers. This platform can be accessed via the following website: http://ec.europa.eu/odr.

RECOMMENDATIONS FOR LOSS OF WARRANTY

• The equipment may not be in a place with an ambient temperature above 16°CThis would cause the machine to overheat, which is detrimental to its proper operation.

• The place of operation of the equipment must not be humid, due to the low tolerance level of the plate to water.
  • The amperage at which power is supplied to the equipment must be checked, as incorrect amperage could cause a short circuit that could damage the ASIC or RIG.
  • Any configuration or modification of the ASIC or RIG must be verified and approved by the technical service of the MinandoVoy. We do not assume liability for modifications made by another company or by the customer.
  • The equipment must not be knocked or dropped, as this will void the warranty due to customer negligence.
  • In case of malfunctions, the customer must contact the technical service. If the customer disassembles, manipulates or modifies the machine (including overclocks of graphics cards in RIGs), he will automatically lose the warranty.
  • In the event of transport damage or manufacturing faults within the warranty period, MinandoVoy will take care of the repair. The customer must send the machine in good packing conditions and with protections. If it arrives without adequate protection, MinandoVoy shall not assume responsibility for repairs.
  • Regular maintenance of the equipment is necessary: clean fans once a month and apply thermal paste when necessary (in case of RIGs). Lack of maintenance that causes damage will be considered as out of warranty. This maintenance is not included in the price.

11. Política de devoluciones

De acuerdo con la normativa vigente en materia de defensa de los consumidores y usuarios, el cliente dispone de un plazo de 14 días naturales desde la recepción del pedido para ejercer su derecho de desistimiento, sin necesidad de justificar el motivo.

1. Plazo de devolución

El plazo para solicitar una devolución es de 14 días naturales desde la fecha en la que el cliente o un tercero autorizado por él recibe el producto.

2. Condiciones para la devolución

Para que la devolución sea aceptada, el producto debe:

Estar en perfecto estado, sin usar.

Conservar su embalaje original, instrucciones y accesorios, si los hubiera.

No presentar daños derivados de un uso indebido.

3. Productos excluidos de devolución

No se admitirán devoluciones en los siguientes casos, salvo que el producto sea defectuoso o exista error en el envío:

Productos personalizados o confeccionados conforme a las especificaciones del cliente.

Bienes que, por razones de higiene o salud, no sean aptos para ser devueltos si han sido desprecintados.

Contenidos digitales suministrados por vía electrónica cuando la ejecución haya comenzado con el consentimiento del cliente.

4. Procedimiento de devolución

Para ejercer el derecho de desistimiento, el cliente deberá comunicarlo de forma expresa a través del correo electrónico indicado en la web, facilitando los datos del pedido.

Una vez recibida la solicitud, se indicarán los pasos a seguir para el envío del producto.

5. Gastos de devolución

Los gastos directos de devolución correrán a cargo del cliente, salvo en caso de producto defectuoso o error en el envío, en cuyo caso serán asumidos por la empresa.

6. Reembolso

Una vez recibido el producto y comprobado su estado, se procederá al reembolso del importe correspondiente utilizando el mismo medio de pago empleado en la compra, en un plazo máximo de 14 días naturales desde la recepción del producto devuelto.
